VA Updates Loss Mitigation Rules: What It Means for VA Loan Borrowers
The VA has revised its loss mitigation guidelines, introducing a clearer step-by-step process to help struggling borrowers avoid foreclosure. Here's what this means if you have a VA loan.
If you have a VA loan and are facing financial hardship, some important new rules just went into effect that could work in your favor.
The Department of Veterans Affairs recently updated its guidelines for how mortgage servicers must handle delinquent VA loans. The new process follows a clear waterfall: servicers must first explore a forbearance option, then a repayment plan, then a standard loan modification, and then a 30-year modification — before considering a partial claim or, as a last resort, a 40-year modification.
One of the most borrower-friendly aspects of the final rule is this: if a 30-year modification would actually increase your monthly payment and you don't yet qualify for a partial claim, your servicer must go back and explore a repayment plan instead. This protects borrowers from being pushed into a modification that makes their situation worse.
The partial claim option — which essentially defers missed payments to the back of the loan — becomes available after three full months of missed payments.
Bottom line: if you're a California veteran struggling with your mortgage, these updates give you more structured protections. Don't navigate this alone — contact our team today to understand your options and find the best path forward.
